Ballyshannon await decision on grant of leave for Judicial Review proceedings

Ballyshannon Action Group members at the High Court

20. 10. 2022.

Our application for leave to have a judicial review of the An Bord Pleanala decision to allow Kilsaran proceed with their quarry plans at Racefield was heard by Mr Justice Meenan today in the High Court.

While An Bord Pleanala remained a neutral party in proceedings, Kilsaran took the opportunity to argue against our right to seek a judicial review.

We are confident that we have a strong case and that we meet the requirements for those seeking judicial review. All we can do now is wait and hope that the Judge agrees.

Our Case was covered in today’s Irish Times https://www.irishtimes.com/crime-law/courts/2022/10/20/quarry-firm-challenges-community-groups-legal-capacity-to-bring-high-court-case/
